Core Responsibilities

Primary Functions

  • Lead the defense of civil lawsuits from intake to resolution, including drafting and filing pleadings, answers, counterclaims, and affirmative defenses tailored to jurisdictional and client-specific strategy.
  • Conduct comprehensive case intake and early case assessment to identify exposures, coverage issues, potential third-party liability, and strategic settlement opportunities consistent with client objectives.
  • Prepare, serve, and respond to written discovery (interrogatories, requests for production, admissions) and coordinate production of documents in compliance with Federal Rules of Civil Procedure and applicable state rules.
  • Plan and oversee depositions of parties, fact witnesses, and expert witnesses; prepare witness outlines, coordinate logistics, and use deposition testimony strategically for summary judgment and trial preparation.
  • Draft, research, and argue dispositive motions, motions in limine, summary judgment motions, and other substantive motions in state and federal courts, including oral argument before judges.
  • Manage and execute discovery strategies involving complex e-discovery, including preservation letters, legal holds, ESI collection protocols, review workflows, privilege logging, and coordination with e-discovery vendors (e.g., Relativity).
  • Supervise and coordinate expert retention: develop expert scopes, draft expert reports, prepare experts for depositions and trial testimony, and challenge opposing expert reports through Daubert/Kumho motions when appropriate.
  • Develop and implement litigation budgets and matter staffing plans; monitor legal spend, generate periodic budget forecasts, and work with clients to manage costs and maximize value.
  • Negotiate settlements, mediations, and alternative dispute resolution outcomes on behalf of clients, drafting settlement agreements, releases, and ensuring enforceability of resolutions.
  • Prepare thorough trial work product: trial briefs, jury instructions, voir dire, exhibit lists, demonstratives, witness examinations, and trial exhibits; coordinate courtroom technology and logistics.
  • Counsel corporate and insurance clients on claim handling, coverage positions, reservation of rights, and bad faith risk mitigation while collaborating with coverage counsel as needed.
  • Conduct legal research using Westlaw/Lexis and other legal research platforms to support briefs, motions, and strategic decisions; synthesize case law and statutory authority into persuasive legal arguments.
  • Manage caseloads effectively using case management systems (e.g., iManage, Clio, MyCase), maintain calendaring and deadlines, and ensure compliance with court rules and firm or client SLAs.
  • Supervise, mentor, and train junior associates, paralegals, and legal assistants on litigation practice, motion drafting, deposition strategies, and trial preparation, reviewing work product and providing constructive feedback.
  • Liaise directly with claims adjusters, in-house counsel, risk managers, and insureds to align litigation strategy with client business objectives and to provide regular, clear status updates.
  • Coordinate and manage outside counsel and vendors, including investigators, private counsel in other jurisdictions, e-discovery vendors, and expert consultants to ensure quality and cost-effective representation.
  • Conduct investigations and fact-gathering, including witness interviews, site inspections, photographic documentation, and preservation of physical evidence, to build a strong factual record.
  • Draft and respond to pre-litigation demand letters, coverage opinions, and litigation hold notices; evaluate exposure and provide actionable recommendations to avoid or manage litigation.
  • Prepare and defend clients in administrative proceedings and alternative forums when civil disputes intersect with regulatory or administrative claims.
  • Ensure ethical compliance with professional responsibility rules and client confidentiality and implement appropriate privilege protections throughout litigation.
  • Present oral arguments, status updates, and strategy sessions to clients and internal stakeholders; translate complex legal issues into practical recommendations and risk assessments.
  • Monitor and analyze changes in civil litigation developments, statutory amendments, and relevant case law to proactively update clients and adapt defense strategies.
  • Maintain and improve litigation templates, precedents, checklists, and knowledge management tools to increase departmental efficiency and quality of work product.
  • Assist in business development activities including client pitches, proposals, CLE presentations, and industry networking to grow the civil defense practice.

Educational Background

Minimum Education:

  • Juris Doctor (J.D.) degree from an accredited law school.
