Core Responsibilities

Primary Functions

  • Provide strategic legal advice and counsel to clients and business leadership on compliance with a broad spectrum of federal, state, and local environmental laws, including the Clean Air Act (CAA), Clean Water Act (CWA), RCRA, CERCLA/Superfund, TSCA, and NEPA.
  • Represent the company or clients in environmental litigation, including defending against enforcement actions, citizen suits, and toxic tort claims from inception through resolution.
  • Manage all phases of litigation, including drafting pleadings, managing discovery processes, taking and defending depositions, arguing motions, and participating in settlement negotiations or trials.
  • Conduct comprehensive environmental due diligence for corporate transactions, including mergers, acquisitions, divestitures, and real estate deals, identifying potential liabilities and drafting protective contractual provisions.
  • Negotiate and draft complex environmental agreements, such as consent decrees, settlement agreements, access agreements, and environmental indemnities.
  • Guide clients through the complex process of obtaining, renewing, and complying with environmental permits and governmental authorizations for new and existing projects and facilities.
  • Advise on legal requirements and strategic approaches for the remediation and redevelopment of contaminated properties, including navigating Brownfields programs and interacting with regulatory agencies.
  • Counsel on emerging environmental issues, including climate change regulations, renewable energy project development, water rights, and corporate sustainability/ESG reporting and disclosure standards.
  • Serve as the primary point of contact and advocate for clients in interactions with regulatory agencies, including the U.S. EPA and state environmental protection departments, during inspections, investigations, and negotiations.
  • Analyze proposed legislation and new regulations to assess their potential impact on business operations and develop proactive compliance strategies.
  • Manage outside counsel, technical experts, and environmental consultants effectively to ensure high-quality, cost-efficient support on complex legal and technical matters.
  • Provide legal oversight for environmental incident response, including internal investigations, reporting obligations, and crisis management.

Secondary Functions

  • Develop and deliver training programs for employees and management on environmental compliance, legal developments, and best practices.
  • Support the development and implementation of corporate-wide environmental management systems (EMS) and compliance assurance programs.

  • Oversee and refine processes for legal holds and e-discovery related to environmental claims and litigation.
  • Contribute to the continuous improvement of the legal department's processes and knowledge management resources.

Required Skills & Competencies

Hard Skills (Technical)

  • Deep Statutory Expertise: In-depth knowledge of major U.S. environmental laws (e.g., CERCLA, RCRA, CWA, CAA) and related state-level regulatory frameworks.
  • Environmental Litigation: Proven experience in managing civil, administrative, or criminal environmental litigation, including discovery, motion practice, and trial/hearing preparation.
  • Regulatory Permitting & Compliance: Skill in navigating the environmental permitting process and counseling on complex compliance issues across various media (air, water, waste).
  • Transactional Due diligence: Proficiency in identifying and assessing environmental risks in M&A, real estate, and financing transactions.
  • Agency Negotiation: Demonstrated ability to negotiate effectively with federal (EPA) and state environmental regulatory agencies.
  • Contract Drafting & Negotiation: Expertise in drafting and negotiating environmental provisions in a wide range of commercial agreements and settlements.
  • Legal Research & Analysis: Advanced proficiency with legal research platforms (Westlaw, LexisNexis) to analyze complex legal issues and prepare persuasive legal memoranda.

Education & Experience

Educational Background

Minimum Education:

  • A Juris Doctor (J.D.) degree from an ABA-accredited law school.
  • Admission to and good standing with at least one U.S. State Bar.

Preferred Education:

  • J.D. with a formal concentration, certificate, or journal experience in Environmental or Energy Law.
  • LL.M. in Environmental Law is a significant plus.

Relevant Fields of Study:

  • Law
  • Environmental Science or Policy (as an undergraduate or dual degree)

Experience Requirements

Typical Experience Range: 4-12 years of direct experience in environmental law.

Preferred: Experience gained within a nationally recognized law firm's environmental practice group, a sophisticated corporate in-house legal department, or a federal/state environmental regulatory agency. A combination of firm and in-house experience is highly desirable.
