Core Responsibilities
Primary Functions
- Manage the entire real estate closing process from opening the escrow account to the successful disbursement of funds and post-closing follow-up.
- Conduct a thorough review of residential and commercial purchase agreements, joint escrow instructions, and lender instructions to ascertain the requirements for a compliant closing.
- Prepare accurate and detailed closing statements, including the ALTA Settlement Statement and Closing Disclosure (CD), ensuring all financial figures are balanced and correct.
- Proactively identify, address, and clear all title report requirements, such as liens, judgments, and other encumbrances, prior to closing.
- Order, review, and approve demands for payoffs of existing mortgages, HOA dues, taxes, and other liens, ensuring their timely payment.
- Balance the escrow file by meticulously accounting for all incoming and outgoing funds, preparing wire transfers, and issuing checks from the trust account.
- Serve as the primary liaison for all parties involved in the transaction, including buyers, sellers, real estate agents, and mortgage lenders, providing proactive status updates and exceptional customer service.
- Prepare and facilitate the signing of all necessary closing documents, including grant deeds, trust deeds, notes, and various affidavits, ensuring all are properly executed and notarized.
- Coordinate and often conduct the final closing appointment, clearly explaining all documentation to the signing parties and answering their questions.
- Ensure strict adherence to all company policies and legal regulations, including RESPA, TRID, and other state-specific escrow laws.
- Resolve complex file issues and disputes by leveraging deep industry knowledge, creative problem-solving skills, and effective communication.
- Cultivate and maintain strong relationships with a portfolio of clients, including real estate agents and lenders, to drive repeat business and foster a positive reputation.
- Review and comprehend complex lender's instructions and loan documents to ensure all conditions for funding are met.
- Oversee the timely recording of all legal documents with the appropriate county recorder's office to officially transfer title.
- Prepare and issue final title insurance policies to the new owner and/or lender following the successful close of escrow.
Secondary Functions
- Actively participate in business development and marketing efforts by networking with industry professionals to expand the client base.
- Mentor, train, and provide guidance to Escrow Assistants and other junior team members to foster their professional growth.
- Maintain impeccable and organized electronic and physical files, ensuring all documentation is securely stored and compliant with record-retention policies.
- Assist management and auditors by preparing reports on file volume, turn-times, and other key performance indicators.
