Core Responsibilities
Primary Functions
An Immigration Advisor is at the heart of the immigration process, managing cases from start to finish with precision and care. Your primary duties will revolve around direct case management, client advisement, and legal compliance.
- Provide comprehensive and strategic advice to corporate clients, employees, and individuals on the full spectrum of immigration matters, including non-immigrant and immigrant visa pathways.
- Meticulously prepare, review, and file a high volume of complex visa petitions and applications, such as H-1B, L-1, O-1, TN, PERM, and Adjustment of Status applications.
- Independently manage a significant caseload from initiation through to completion, ensuring all deadlines are met and case milestones are tracked accurately in the case management system.
- Serve as the primary, empathetic point of contact for clients, foreign nationals, and internal stakeholders, providing regular status updates and proactively addressing questions and concerns.
- Conduct in-depth legal research on complex or novel immigration issues to develop case strategies and stay current with changes in immigration laws, regulations, and agency procedures.
- Strategically draft and prepare detailed, persuasive, and well-documented responses to government inquiries, such as Requests for Evidence (RFEs) and Notices of Intent to Deny (NOIDs).
- Develop and deliver training sessions for HR partners, recruiters, and business managers on immigration processes, compliance requirements, and best practices for supporting foreign national employees.
- Uphold strict compliance with immigration laws and regulations, including managing and auditing Public Access Files (PAFs) and ensuring adherence to I-9 and E-Verify protocols.
- Effectively liaise with government agencies like USCIS, DOL, and DOS to track case progress, troubleshoot issues, and advocate on behalf of clients.
- Skillfully manage client expectations regarding processing times, case strategies, and potential outcomes, providing realistic and transparent counsel throughout the process.
- Oversee the entire PERM labor certification process, including advising on job description requirements, managing recruitment advertising campaigns, and filing applications with the Department of Labor.
- Guide new clients and employees through the intake and onboarding process, gathering necessary documentation and clearly explaining the steps involved in their immigration journey.
- Critically review and analyze client-provided information and documentation for accuracy, completeness, and consistency before submission to government agencies.
- Diligently maintain and update all case-related information, correspondence, documentation, and deadlines in the firm's or company's designated case management software.
- Prepare and counsel clients for visa interviews at U.S. consulates abroad and for adjustment of status interviews with USCIS, ensuring they are confident and well-informed.
- Provide expert guidance to foreign nationals regarding international travel, visa stamping procedures, and the critical importance of maintaining valid immigration status while in the country.
- Thoroughly assess individual eligibility for various immigration benefits and advise on the most suitable and strategic options available based on their unique circumstances.
- Draft compelling and well-supported letters and legal arguments to accompany petitions and applications, tailored to the specific facts and merits of each case.
- Actively monitor Visa Bulletin movements and priority date progression to advise clients on the optimal timing for filing adjustment of status applications.
- Collaborate closely with supervising attorneys and senior team members to develop sophisticated case strategies and ensure the highest quality of legal work and client service.
Secondary Functions
Beyond direct case management, an Immigration Advisor contributes to the overall health and efficiency of the team and practice.
- Contribute to the continuous improvement of internal immigration processes, workflows, and template documents to enhance efficiency and quality.
- Participate in mentoring and training junior paralegals or case assistants, sharing knowledge and fostering a collaborative team environment.
- Assist in generating reports on caseload, processing times, approval rates, and other key metrics for internal analysis and client review.
