Core Responsibilities

Primary Functions

  • Manage the end-to-end U.S. and/or global immigration casework, including non-immigrant and immigrant visas (e.g., H-1B, L-1, TN, O-1, E-3) and permanent residency applications (e.g., PERM, I-140, I-485).
  • Serve as the primary point of contact for employees, managers, and external counsel, providing clear, timely, and accurate information regarding case strategy, status updates, and required actions.
  • Conduct thorough initial assessments of potential immigration cases to determine eligibility, identify potential challenges, and develop appropriate filing strategies in collaboration with legal counsel.
  • Meticulously prepare and review complex immigration petitions, applications, and supporting documentation to ensure completeness, accuracy, and compliance with government regulations before submission.
  • Proactively monitor and track critical deadlines and expiration dates for visas, work authorizations, and other immigration statuses using case management software and internal tracking systems.
  • Oversee and ensure strict compliance with Labor Condition Application (LCA) regulations, including the posting, maintenance, and audit-readiness of Public Access Files (PAFs).
  • Coordinate the recruitment and advertising stages of the PERM labor certification process, ensuring all Department of Labor (DOL) requirements are rigorously met.
  • Develop and deliver comprehensive training sessions and create resource materials for recruiters, HR partners, and managers on immigration policies, processes, and best practices.
  • Counsel and support employees and their families on a wide range of immigration-related issues, including travel requirements, dependent visa applications, and the process of adjusting to a new country.
  • Partner with external immigration law firms to manage case volume, ensure service level agreements (SLAs) are met, review legal strategies, and scrutinize invoices for accuracy.
  • Maintain up-to-date and in-depth knowledge of evolving U.S. and international immigration laws, regulations, and policy changes, and analyze their potential impact on the company and its employees.
  • Lead or contribute to special projects related to immigration program enhancements, such as policy updates, process automation, and the implementation of new immigration technologies.
  • Manage the company's response to government requests for evidence (RFEs), audits, and site visits, working closely with legal counsel to formulate and submit robust responses.
  • Ensure the absolute confidentiality and security of sensitive personal information and immigration documentation in accordance with data privacy regulations like GDPR and CCPA.
  • Generate and analyze immigration-related data and metrics to provide insights on trends, costs, and processing times to senior leadership for strategic planning and budget forecasting.
  • Act as a compassionate and trusted advisor to the foreign national population, providing guidance and reassurance throughout their immigration journey with the company.
  • Collaborate with the Global Mobility team on relocation logistics, tax implications, and other aspects of international assignments that intersect with immigration processes.
  • Facilitate the onboarding process for new foreign national hires, ensuring their work authorization is secured and documented prior to their start date.
  • Develop and maintain strong working relationships with internal stakeholders, including Talent Acquisition, Legal, Finance, and business leaders, to ensure alignment on immigration matters.
  • Conduct regular audits of immigration files and processes to identify any gaps or areas for improvement, ensuring the program remains compliant and efficient.
  • Advise the business on immigration implications related to corporate restructuring, mergers and acquisitions, and changes in employee job duties or work locations.

Secondary Functions

  • Provide timely support for ad-hoc immigration-related inquiries and data requests from employees, managers, and business leaders.
  • Actively contribute to the development and refinement of the company's global mobility and immigration strategy and policy roadmap.
  • Collaborate closely with HR Business Partners, Talent Acquisition, and business unit leaders to translate their talent and mobility needs into actionable immigration strategies and requirements.
  • Participate in regular team meetings, case reviews, and project planning sessions to ensure alignment and efficient workflow within the immigration and mobility team.

Required Skills & Competencies

Hard Skills (Technical)

  • Deep subject matter expertise in U.S. business immigration laws, procedures, and policies (non-immigrant and immigrant).
  • Proficiency with immigration case management software (e.g., LawLogix, Tracker, INSZoom, Envoy).
  • Strong experience with the PERM labor certification process from start to finish.
  • Comprehensive understanding of Public Access File (PAF) and LCA compliance requirements.
  • Ability to accurately interpret and apply complex legal regulations and government agency guidance.
  • Experience managing I-9 compliance and E-Verify processes.

Education & Experience

Educational Background

Minimum Education:

  • Bachelor's Degree or equivalent practical experience in a relevant field.

Preferred Education:

  • Juris Doctor (JD) from an accredited law school or a Paralegal Certificate.

Experience Requirements

Typical Experience Range: 3-7 years of direct experience in corporate business immigration, either in-house or at a reputable immigration law firm.
