Core Responsibilities
Primary Functions
- Manage the end-to-end lifecycle of U.S. employment-based non-immigrant and immigrant visa cases, including H-1B, L-1, TN, O-1, E-3, and others, from initiation to completion.
- Partner closely with external immigration counsel to strategize and prepare complex petitions, applications, and responses to government inquiries, ensuring high-quality submissions.
- Serve as the primary point of contact for employees, managers, and HR partners, providing clear and empathetic guidance on immigration processes, timelines, and strategies.
- Oversee the entire PERM labor certification process, including recruitment efforts, audit file preparation, and meticulous documentation to ensure full compliance with Department of Labor regulations.
- Initiate and manage employment-based green card cases (EB-1, EB-2, EB-3), guiding employees through the multi-stage I-140 and I-485 processes with clarity and support.
- Diligently track and monitor critical deadlines and expiration dates for visas, work permits, and passports using case management systems and internal trackers to prevent any lapse in status.
- Conduct thorough reviews of all immigration-related forms (e.g., I-129, I-140, I-907) and supporting documents for accuracy and completeness before submission to government agencies.
- Develop and maintain comprehensive documentation and Public Access Files (PAFs) for H-1B and E-3 petitions, ensuring they are organized, complete, and audit-ready at all times.
- Provide expert consultation to the talent acquisition team and hiring managers on the immigration implications of potential hires, internal transfers, and promotions.
- Respond effectively and strategically to complex government challenges, including Requests for Evidence (RFEs) and Notices of Intent to Deny (NOIDs), by gathering evidence and drafting compelling responses.
- Maintain the integrity of all immigration data within the HRIS and case management systems, ensuring records are consistently accurate, confidential, and up-to-date.
- Lead I-9 and E-Verify compliance programs for the entire organization, including conducting regular self-audits and providing training to ensure adherence to federal regulations.
- Proactively stay abreast of changes in U.S. immigration laws, regulations, and policies, and effectively communicate the business impact of these changes to relevant stakeholders.
- Collaborate on the development and continuous refinement of the company's internal immigration policies, procedures, and service level agreements to enhance efficiency and the employee experience.
- Manage relationships and performance of external immigration law firms and other vendors, including invoice review, budget tracking, and performance feedback.
