Core Responsibilities
Primary Functions
- Prepare and file U.S. trademark applications, including extensions of time, statements of use, declarations of use and incontestability, and renewal applications with the USPTO.
- Manage and coordinate international trademark filings through the Madrid Protocol and by engaging with a network of foreign counsel and agents.
- Conduct and analyze preliminary and comprehensive trademark clearance searches using databases like Corsearch, Saegis, USPTO's TESS, and WIPO's Global Brand Database to assess the availability of new marks.
- Meticulously manage and maintain the trademark docketing system (e.g., WebTMS, Anaqua, FoundationIP), ensuring all deadlines for office actions, renewals, and other critical dates are tracked and met.
- Assist attorneys in responding to office actions from the USPTO and foreign trademark offices by gathering evidence of use, preparing draft arguments, and coordinating with business units.
- Draft legal correspondence and formal documents, including cease and desist letters, consent and coexistence agreements, assignments, and licenses under attorney supervision.
- Support trademark enforcement actions, including gathering evidence for opposition and cancellation proceedings before the Trademark Trial and Appeal Board (TTAB) and in foreign jurisdictions.
- Assist with Uniform Domain Name Dispute Resolution Policy (UDRP) proceedings by preparing complaints and gathering evidence of trademark rights and bad faith registration.
- Review marketing collateral, product packaging, and websites to ensure proper trademark usage, including correct marking (®, ™, ℠) and attribution.
- Prepare and record trademark assignment and security interest documents with the USPTO and foreign trademark offices, often in support of M&A or financing activities.
- Communicate directly with foreign associates and agents regarding filing strategies, prosecution matters, and local legal requirements for brand protection.
- Organize and maintain extensive digital and physical files for all trademark matters, ensuring documentation is readily accessible for litigation, due diligence, or audits.
- Support intellectual property litigation by assisting with discovery, evidence collection, and trial preparation related to trademark disputes.
- Perform due diligence reviews of trademark portfolios in connection with corporate transactions, including mergers, acquisitions, and divestitures.
- Prepare status reports and portfolio summaries for attorneys and business clients, providing clear updates on the health and status of the trademark portfolio.
